DNC POLICY
Neo-Dom, LLC, a Texas Limited Liability Co., dba Envy Luxe Vacations & Escapes and/or its affiliated companies including third-party RTMs (collectively, the “Company”) strive to support the consumer service experience and is committed to complying with all applicable federal and state laws. It is the policy and intent of the Company to comply with all applicable Do Not Call (“DNC”) laws and regulations. This document sets forth the Company’s policy regarding compliance with state and national do-not-call rules, and the establishment and maintenance of an internal do-not-call list (“IDNC”).
The Company prohibits the placement of any telemarketing calls (which for purposes of this DNC Policy include text messages) to consumers where prohibited by applicable federal and state Do Not Call laws and regulations. This does not apply to consumers who have provided their prior express consent, or prior express written consent, as applicable, to be contacted. When telemarketing activities are conducted by authorized third-party marketing vendors on behalf of the Company, such vendors are expected to comply with all applicable federal and state Do Not Call requirements, including the use of current National Do Not Call Registry data where required by law.
The Company also maintains a company-specific IDNC and will honor any request to be placed on the IDNC within a reasonable time of such request, not to exceed thirty (30) days from the date of such request. Each entry on the IDNC will be maintained for at least ten (10) years or until the consumer makes a request to be removed from the IDNC or provides a new consent to be contacted. If a consumer changes their telephone number or adds an additional telephone number, it is their duty to provide the Company with their new telephone number to replace or supplement the phone number previously placed on the IDNC to prevent calls to that number.
In compiling a list of consumers to call for a particular telemarketing campaign, the Company and/or its authorized third-party marketing vendors will scrub and not include any consumer whose account record is marked "do not call." Such suppression shall apply to the Company's Internal Do Not Call List and any applicable federal and state Do Not Call registries, as required by applicable law.
As a matter of policy, the Company requires all third-party RTMs telemarketing at its request and under its direction to ensure they are following applicable federal and state laws regarding telemarketing and that they fully understand and agree to follow the procedures for maintaining DNC data as outlined in this DNC Policy. The Company requires its RTMs to promptly report to the Company all consumer requests to be placed on a do-not-call list or otherwise removed from future telephone solicitations so that each request can be added to the Company's Internal Do Not Call List. The Company prohibits telemarketing activities conducted in violation of the TCPA, applicable federal regulations, and applicable state telemarketing laws.
The Company requires all third-party RTMs that make telephone solicitations for the Company to:
- Institute procedures for maintaining an IDNC list of consumers who do not wish to receive telephone solicitations;
- Scrub all leads against the Company's Internal Do Not Call List and any applicable federal and state Do Not Call registries, as required by applicable law, before initiating any telephone solicitations.
- When applicable, scrub against required state and federal DNC registries.
- Institute and maintain a procedure to capture all DNC requests and transmit them in a daily results file to the Company.
- Develop a written policy implementing this requirement to keep an IDNC list and make this written procedure available to anyone on demand.
- Maintain the IDNC list for a period of 10 years and refrain from selling or sharing the IDNC list (except with a subsidiary or affiliated company) without the consumer's consent.
- Train and inform any personnel engaged in any aspect of telephone solicitation in the existence and use of the IDNC list and this DNC Policy.
- Provide any consumer who has received a call with the name of the individual caller, the Company's name (Envy Luxe Vacations & Escapes) and telephone number (512-878-9104) or address (539 West Commerce St. #1887 Dallas, Texas 75208) at which that person or the Company may be contacted.
- Make a record of the name and telephone number of any consumer who requests not to be called again and forward such record to (a) the Company, via the daily results file, (b) the party maintaining the RTM's IDNC list and (c) affiliated entities (where appropriate); and
- Place the consumer's name and number on the IDNC list of any affiliate of the RTM where the consumer would reasonably expect to be included on such list given the identity of the telemarketer and the product or service being advertised.

Please note that the Company's IDNC only restricts calls from the Company that are subject to the applicable federal and state laws, so consumers may continue to receive calls that are not subject to applicable federal and state laws, or from other companies that are not affiliated with the Company.
Consumers have additional avenues available to them that will help reduce or eliminate unwanted telephone solicitations. Consumers may place their telephone number(s) on the National Do Not Call Registry by calling 1-888-382-1222 or online at www.donotcall.gov.
In addition, the Direct Marketing Association also offers a free service titled "Telephone Preference Service." Consumers may register for this service online at www.dmachoice.org.
